Saha. …for the petitioner. Mr. Kaushik Dey Mr. Tapan Bhanja. …for the Union of India/Customs Authority. Learned advocate appearing for the petitioner submits that the alleged recovery in the present case is 17232 grams of ganja and the same was after it was intercepted at the Airport. Learned advocate for the Air Customs Authority opposes the prayer for bail. However, it has been informed to this Court that the complaint has already been filed before the jurisdictional court. Having considered the materials in the present case, I am of the opinion that the same is covered by the judgment of Hon’ble Supreme Court in Barnali Bag Vs. Union of India (Special Leave Petition (Crl.) No.3641 of 2026). As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner, namely, Mr. Lakhi Ashok 2 Chawla shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, 8th Court, under NDPS Act, Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of 24 Parganas (North) without prior permission of the learned special court. Additionally, the petitioner shall meet with the investigating officer of the case or the Principal Commissioner, Airport, Air Customs Authority as and when called for. Accordingly, CRM(NDPS) 1845 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
