Upon inspection by the authorized officials of Bhilai Steel Plant, the vehicles were found to be carrying iron scrap allegedly transported in an unauthorized and illegal manner. On the basis of the said complaint, FIR was lodged and investigation commenced.
3.
Learned counsel for the applicant would submit that applicant has been falsely implicated in the present crime. He has not committed any offence as alleged. She submits that applicant is employee of Himanshu Khandelwal and is operator of JCB. She submits that he works only as per the direction issued by Himanshu Khandelwal who is also co- accused in the instant crime. Himanshu Khandelwal has been enlarged on bail vide order dated 04.08.2026 in MCRCA No. 1244 of 2026. The case of applicant is on better footing and he has no criminal antecedent registered against him. She lastly submits that many other co-accused persons have been enlarged by the Co-ordinate Bench of this Court. The co-accused who have been granted anticipatory bail are namely Girish Khandelwal, Himanshu Khandelwal, Abhay Singh, Vijendra Kumar Dhuriya, Shiv Kumar Koutarya, Umakant Panda, Vishnu Kumar, Hence he may be enlarged on bail. The co-accused who have been granted regular bail are namely Sanjay Singh, Manoj Kumar Sharma,
3 Upendra Pintu Ojha, Mithen Markan, Akash Kumar Singh, Tej Ram, Geetesh Kumar, Sitanand Sahu, Kailash Sharma, Bhaskar Mudliyar, Nirmal Singh, Ghanshyam Prasad Gupta and Ravendra Sahu. Hence the present applicant be also enlarged on bail. 4. On the other hand, learned State counsel opposes the submission of counsel for applicant however, he do not dispute the submission made by learned counsel for applicant with regard to the status of applicant to be a JCB Operator and an employee of Himanshu Khandelwal. Upon putting query, he further submits that many other co-accused persons have been enlarged on bail either by granting regular bail or anticipatory bail. 5. I have heard learned counsel for the respective parties. 6. On due consideration of the facts and circumstances of the case, nature of allegation, submission of learned counsel for the parties and further considering that other co-accused persons have been enlarged on bail, without commenting anything on merits, I am inclined to allow this anticipatory bail application. 7. Accordingly, application is allowed and it is directed that in the event of arrest of applicant in connection with the crime in question (130/2026), he shall be released on anticipatory bail by the Officer arresting him on his executing a personal bond in the sum of ₹25,000/- with one surety in the like sum to the satisfaction of the concerned arresting Officer.
