Mr. Abhinaba Dan, Advocate Ms. Sremayee Datta, Advocate … for the petitioner The present writ petition has been filed alleging non-payment of the petitioner’s dues despite the successful execution of a work order issued by the Executive Officer, Raipur Panchayat Samity, Bankura. It is not in dispute that, during the pendency of this writ petition, the petitioner has received the entire value of the work order amounting to Rs. 4,77,120/-. Learned counsel appearing for the petitioner seeks interest on account of the delayed payment. It, however, appears that the delay was caused, as the requisite funds were not available at the material point of time. In my view, there is no statutory provision for the grant of interest in such circumstances. Determination of interest would require adjudication of factual matters, which cannot be undertaken in 2 writ jurisdiction. In the circumstances, this Court is not inclined to grant any interest in the present petition. The petitioner, however, shall be at liberty to file a civil suit claiming interest, if so advised. WPA 7812 of 2025 is disposed of accordingly. Urgent Photostat certified copy of this order, if applied for, be supplied to the learned Advocates for the parties on usual undertaking.
