Accused No.2 in Crime No.102 of 2026 registered by Mandya East Police Station, Mandya for offences punishable under Sections 352, 329(3), 118(1), 115(2), 324(4), 351(2) & 190 of BNS, 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.102 of 2026 was registered by Mandya East Police Station, Mandya District for the aforesaid offences against one Raju and others, based on information dated 01.07.2026 received from Sri Gurudath A R, who is one of the injured victim in the present case. Apprehending arrest in the case, the petitioner had approached the jurisdictional Sessions Court in Crl.Misc.No.631 of 2026, which was rejected on 16.07.2026. Therefore, he is before this Court. 4. Perusal of the first information would reveal that on the night of 30.06.2026 at about 11.20 p.m., the accused persons, who had consumed alcohol in 'Shivaleela bar and - 3 - HC-KAR CNR: KAHC010545972026 NC: 2026:KHC:47301 CRL.P No. 12041 of 2026 restaurant', in which the first informant was working as a cashier allegedly quarreled with him when he asked them to pay the money for the alcohol consumed. Thereafter, accused persons allegedly assaulted the first informant and another employee of the bar and restaurant with beer bottles and other bottles causing injuries to the first informant and the other employee. It is also alleged that accused persons damaged the property in the bar and restaurant and they broke beer and other liquor bottles worth Rs.25,000/- to Rs.30,000/-. 5. Wound certificate of the first informant would go to show that he has suffered four injuries and out of that one injury which is a fracture injury is certified as a grievous injury. The other employee who was assaulted by the accused persons has suffered simple injures in the incident in question. 6. Learned HCGP has brought to the notice of this Court that other accused who were present along with the petitioner at the time of alleged incident are rowdy elements and only for the reason that the victim had asked the accused persons to pay money for the alcohol consumed by them, they have been assaulted by accused. He also brings to the notice - 4 - HC-KAR CNR: KAHC010545972026 NC: 2026:KHC:47301 CRL.P No. 12041 of 2026 that entire incident in question has been recorded in the CCTV footage of the bar and restaurant. Under the circumstances, I am of the opinion that, the prayer made by the petitioner for grant of anticipatory bail cannot be entertained. 7. Accordingly, criminal petition is dismissed.
