1. Report filed on behalf of the CESC Limited is taken on record. 2. The report reveals that a common service connection exists at the subject premises which caters to as many as 16 meters and the meter board is fully loaded to its capacity. The report also indicates that there is no further space available for installation of any additional meter at the meter board. 3. The said report further indicates that the electrical wiring of the consumers in occupation of the subject premises are hanging dangerously and addition of any new connection will lead to further multiplicity of internal wiring thereby raising serious safety issues. 4. The petitioner’s application has been rejected on the ground that the same is aimed at splitting of load. 2
5. In terms of Regulation 14 of the West Bengal Electricity
Regulatory Commission (Recovery of expenditure for Providing New Connection Regulation, 2013) if an intending consumer’s application for new electricity supply is rejected on the ground of splitting of load, and a dispute is raised as regards the propriety of such refusal the same is to be settled by the relevant Grievance Redressal Officer. The said Regulation also provides that it will be the onus of the applicant to prove that the application for new connection is not for the purpose of splitting of load. 6. In view of the fact that there is a statutory alternative forum available for resolution of such dispute, this writ petition is not entertained. 7. The petitioner is left free to make appropriate application/representation before the relevant Grievance Redressal Officer for the resolution of this dispute. 8. If such application is made, the Grievance Redressal Officer shall dispose of the same in accordance with law within a period of one month from the date of making of such representation. 9. It is made clear that this Court has not gone into the merits of the case and all points are left open to be decided by the Grievance Redresal Officer. 3
10. WPA 19128 of 2026 stands disposed of. No costs. 11.
