The present petition has been filed under Section 528 of the BNSS, 2023 seeking quashing/modification of the order dated 18.08.2026 passed by the Court of learned Judicial Magistrate First Class, Samrala to the extent whereby the petitioner, while being permitted to travel abroad, has been
directed to furnish an FDR/bank guarantee of Rs.7,00,000/- before leaving the country.

Learned counsel for the petitioner submits that the petitioner has no objection to furnishing the personal bond of Rs.6,00,000/- as directed by the learned trial Court. However, the condition of furnishing an FDR/bank guarantee of Rs.7,00,000/- is onerous and beyond the financial capacity of the petitioner. It is submitted that the petitioner is a Government employee and has undertaken to abide by all the conditions imposed by the learned trial Court.

Having regard to the facts and circumstances of the case and without disturbing the permission already granted by the learned trial Court to the petitioner to travel abroad, the condition requiring furnishing of FDR/bank guarantee of Rs.7,00,000/- is modified and reduced to Rs.4,00,000/-. Accordingly, the present petition is disposed of with a direction that the petitioner shall furnish an FDR/bank guarantee of Rs.4,00,000/- in place of Rs.7,00,000/-, while the remaining conditions imposed vide order dated 18.08.2026 shall remain unaltered.
