ORAL ORDER
The petitioner is before this Court seeking the following relief's:
"i) Issue Writ of Mandamus directing the Respondents No.1 to 5 to revoke Travel Ban/Look Out Circular issued by the Respondents No.1 to 5 herein against the Petitioner herein. ii) Issue Writ of Mandamus directing the Respondents No.1 to 5 not to issue any further Travel Ban/Look Out Circular with regard to this case. iii) Issue Writ of Mandamus directing the Respondents No.9 to investigate in the matte regarding infringement of human rights of the Petitioner in the said case and with regard to issue of Travel Ban/Look Out Circular in the above referred criminal case. iv) Grant such other relief/s which deems fit to the facts and circumstances of the case in the interest of justice and equity."
2. It is the submission of learned counsel for the petitioner that the petitioner is an Advocate by profession and a

Cricketer. He has represented Karnataka Advocates Cricket Team and was also the Captain of Indian Advocate's Cricket Team and used to travel abroad in connection with the tournaments. It is his submission that, while he was travelling to take part in a cricket tournament, the petitioner met the complainant who was in the filed of Entertainment Industry. It is his case that, they were in live-in relationship for over a period of 6 months and thereafter, their relationship has strained due to various reasons as set out in the memorandum of writ petition. Those details and other allegations against the complainant need not be re-iterated and the same are not relevant for the purpose for consideration of the present petition. Moreover, the complainant is not a party to this writ petition.
3. What is necessary to be noticed is that on a complaint filed by the complainant on 17.10.2025 in Rajarajeshwari Police Station, an FIR was registered in Crime No.322 of 2025 and the same was submitted to XLVI ACMM, Bengaluru, and thereafter, the complaint was transferred to

Govindrajanagar Police Station without any reason and a Look Out Notice/Circular was issued in an illegal manner.
4. When the matter is taken up for consideration,
learned counsel for the petitioner has vehemently submitted that the action of respondent Nos.3 to 5 in issuing the Look Out Notice/Circular against the petitioner pursuant to the registration of FIR in Crime No.322 of 2025 for the offences punishable under Sections 78(2), 79, 352, 351(2) read with Section 3(5) of BNS, 2023, is illegal and arbitrary

It is the contention of the petitioner that as on the date of registration of FIR, the petitioner was in Srilanka in connection with a cricket tournament and had no intimation about the FIR having been registered. However, when he returned to India and landed at Kempegowda International Airport on 15.11.2025 he was arrested by Govindarajanagara Police Station in view of the Look Out Notice/Circular issued against him. He had no knowledge of the Look Out Notice/Circular. He was produced before the learned Magistrate on the same day. Since the offences alleged against the petitioner were bailable in nature, the petitioner was enlarged

on bail, subject to certain conditions and after compliance of the bail conditions, the petitioner was released. The fact of arrest of the petitioner at the Airport pursuant to Look Out Notice/Circular acquired huge publicity in the News media, so also, in the Social media, which has tarnished the reputation and image of the petitioner, who is an Advocate, so also, a Cricketer. Therefore, submits that the right to privacy and personal liberty of the petitioner has been infringed because of the issuance of Look Out Notice/Circular and consequential arrest and production before the Magistrate. 6. It is necessary to notice that this Court while granting interim order on 04.12.2025, has observed as follows:
"4. Learned AGA is called upon to make his submission as to in what circumstances can a Lookout Circular be issued and could it be issued only on the basis of a private dispute between two parties as regards certain private disputes between them. 5.
It is constrained that the complaint which has been filed is as regard to probably a relationship which has gone sour between the petitioner and the complainant, I am of the

considered opinion that there is no danger of the petitioner being a flight risk requiring a Lookout Circular imposing a travel ban on the petitioner. As such, the Lookout Circular issued against the petitioner is stayed till the next date of hearing."
7. Today, when the matter is taken up for
consideration, learned AGA was confronted with the aforesaid
facts and circumstances, so also, the order dated 04.12.2025 and sought specific submission as to whether official respondents are still implementing the Look Out Notice/Circular and have any intention of recalling the same.

On instructions from the official respondents, learned AGA submitted that the Look Out Notice/Circular issued as against the petitioner would not be implemented anymore, since the petitioner has returned to India, arrested at the Airport and on production before the learned Magistrate, he was enlarged on bail.
9. Though the prayer sought in the writ petition do not survive for further consideration in light of the submissions made by the learned AGA, however, learned counsel for the

petitioner was vehement in his submission that in respect of the offences alleged against the petitioner, which are all bailable in nature, the official respondents have exceeded their jurisdiction in issuing Look Out Notice/Circular, which action is in complete derogation of Articles 19 and 21 of the Constitution of India and therefore, necessary action is to be initiated against the official respondents.

In response to the said submission, learned AGA submits that issuance of Look Out Notice/Circular was necessitated in view of the fact that the petitioner was not available for any contact, in view of his continued travel to abroad. The issuance of Look Out Notice/Circular was un- intentional and it is only to secure the presence of the petitioner for investigation of the crime registered against him.

Learned AGA has filed a memo enclosing the copies of correspondence between the official respondents, more particularly, the copy of communication dated 07.03.2026 addressed by respondent No.3 to Deputy Commissioner of Police, Intelligence, whereby, the request has been made to cancel the Look Out Notice/Circular referring to the interim

order passed in the present writ petition. The memo also contains the immigration records of the petitioner, which has been furnished by respondent No.8 to respondent No.2. The said immigration details discloses that the petitioner is a frequent traveler to abroad from the year 2010 and he has traveled from 2010 till 2025 for about 42 times. The documents produced along with the memo further discloses that the complaint was lodged against the petitioner on 17.10.2025 and the FIR was registered on the same day. From 17.10.2025 till 06.11.2025, what steps the respondent police have taken to trace the petitioner is not forthcoming from the writ petition papers or the documents produced along with the memo. It is on record that the petitioner has traveled to Srilanka only on 06.11.2025 and it cannot be said that in anticipation of his arrest in respect of the crime registered on 17.10.2025, the petitioner has traveled to abroad. It is also to be noticed that the petitioner has returned back to India on
15.11.2025. 12. Taking note of the aforesaid rival submissions, more particularly, the submission of learned AGA that the Look Out

Notice/Circular will no longer be implemented/enforced against the petitioner, this Court is of the view that the apprehension and difficulty expressed by the petitioner is redressed. Therefore, consideration of any of the other submissions made by the petitioner is unwarranted. However, if the petitioner has any grievance as regards the alleged violation of human rights, the same is a separate cause of action, which cannot become part of consideration of the present writ petition. 13. It is noticed that the petitioner has arrayed Karnataka State Human Rights Commission as respondent No.9. However, no relief is sought against the said Commission. Learned counsel for respondent No.9 submits that the petitioner has not approached the Commission complaining infringement of his human rights. If the petitioner approaches the Commission, in the manner known to law, the Commission would consider the same. 14. Recording the submissions of learned AGA that the Look Out Notice/Circular issued as against the petitioner would not be implemented/enforced, the Writ Petition is disposed off.

However, this Court expresses deep displeasure against respondent Nos.3 to 5 for taking extreme step of issuance of Look Out Notice/Circular against the petitioner, pursuant a crime registered against the petitioner for the bailable offences. Ordered accordingly. Sd/- (T.P.VIVEKANANDA) JUDGE
