Ms. Mukherjee, learned Advocate for the petitioner submits that the petitioner allegedly acted as a witness to the deed. He submits that Sarthak Banerjee was the principal accused, who has since died. He prays for bail. 2. Mr. Ghosh, learned Advocate for the State produces the case diary, memo of evidence and opposes the prayer for anticipatory bail. 3. Heard the learned Advocates appearing for the respective parties and perused the materials in the Case Diary. The prosecution case is based on documentary evidence, and the investigation has proceeded fairly, with the prosecution having collected all relevant documents. Therefore, I find no reason to hold that custodial interrogation of the petitioners, for the progress of the investigation, is necessary, and that the privilege under Section 482 of the BNSS can be extended in favour of the petitioners. 4. Accordingly, I direct that, in the event of arrest, each of the petitioners namely, 1) Dulal Mondal @ Nepal Mondal and 2) Prabir Bhattacharya shall be released on bail upon furnishing a 2 bond of Rs. 20,000/- (Rupees Twenty Thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned CJM Paschim Bardhaman, Asansol and also subject to the conditions as laid down under Section 482(2) of the BNSS, 2023. Petitioners shall meet the IO once in a fortnight till submission of charge sheet. 5. The application being CRM (A) 2253 of 2026 is disposed of. (Partha Sarathi Chatterjee, J.)
