Learned advocate appearing for the petitioner submits that the accusation against the petitioner relates to 11970 grams of ganja which was recovered from the Airport. Complaint has already been submitted before the jurisdictional court.
Learned advocate for the Air Customs Authority opposes the prayer for bail.
I have taken into account the subject matter of the case which would be covered by the judgment of Hon’ble Supreme Court in Barnali Bag Vs. Union of India (Special Leave Petition (Crl.) No.3641 of 2026). Having regard to the same, I am inclined to release the petitioner on bail.
Accordingly, the prayer for bail of the petitioner is
2 allowed. The petitioner, namely, Ms. Mariyam Murtaza Nagarwala shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, 8th Court, under NDPS Act, Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of 24 Parganas (North) without prior permission of the learned special court. Additionally, the petitioner would respond and meet the investigating officer of the case physically as and when called for or any Officer deputed by the Principal Commissioner, Airport, Air Customs Authority as and when called for.
Accordingly, CRM(NDPS) 1842 of 2026 is allowed.
