And In the matter of : Dipak Das @ Buro ……Petitioner. Mr. Sourov Mondal Mr. Arijit Bhuiya Mr. Rony Mondal Mr. Debarghyo Sil .....for the Petitioner. Mr. Gouranga Kumar Das, Ld. APP Ms. A. Dey ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for more than five years eleven months. Prosecution is yet to complete two more witnesses. There are no antecedents which are reflecting from the report which has been submitted by the police authorities. Learned advocate appearing for the State opposes the prayer for bail. I have taken into account the period of detention and the fact that some more time will be required to take the trial to its logical conclusion. Further, there are no antecedents as is reflected from the report. Having considered the same, I am inclined to release the petitioner on bail. As such, prayer for bail of the petitioner is allowed. 2 Accordingly, the petitioner, namely, Dipak Das @ Buro shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Alipore, South 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of districts of Kolkata and South 24 Parganas without prior permission of the learned Trial Court. With the aforesaid observations, CRM (M) No. 1717 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
