Kausik (Rejected) CRM (NDPS) 1826 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Duttapukur Police Station Case No. 908/25 dated 24.12.2025 under sections 21(C)/29 of the NDPS Act, 1985. And In the matter of : Ferojuddin ……Petitioner. Mr. Angshuman Chakraborty Mr. S.S. Saha ……for the Petitioner. Mr. Subhabrata Chowdhury Mr. Malay Dhar ……for the State. Learned advocate appearing for the petitioner submits that there has been alleged recovery of 1260 bottles of Wincerex Cough Syrup from a vehicle. Petitioner claims to be the owner of a medical shop having a valid drug licence to carry out the activity. It has also been contended that validly the business was carried out and the cough syrup cartons which were recovered belong to the shop. Learned advocate for the State submits that for retail outlet such huge amount of cough syrup is not required. Learned advocate for the petitioner submits that there are valid documents in custody of the petitioner that in course of business activities such medicines were being obtained. 2 In case there are invoices and other documents, petitioner would first place the same before the learned Special Court. Learned Special Court, if required, will ask for enquiry and thereafter take a fresh decision. In view of the observations made above, I am of the opinion that presently petitioner has failed to make out any case before this Court. Accordingly, prayer for bail of the petitioner in CRM (NDPS) 1826 of 2026 is rejected. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
