The petitioner is apprehending his arrest in connection with Madhuban (Sonardih) P.S. Case No. 89 of 2025, for the offence registered under Sections 303(2), 329(3), 62/3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the Court of Learned Chief Judicial Magistrate, First Class, Dhanbad. 3. Learned counsel appearing for the petitioner submits that the petitioner is the driver of the alleged JCB machine and on the alleged date of occurrence, the petitioner was cleaning the mud in the way of Durga Puja Pandal. He submits that the false allegations are made of opening escape root for theft of coal. He next submits that the petitioner has got no criminal antecedent as disclosed in 15 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of creating rout for the purpose of theft of coal. 5. Considering that the petitioner is having no criminal antecedent 2026:JHHC:8322 2 as disclosed in para 15 of the petition and the allegations are made of cleaning the mud for coal theft, in that view of the matter, the petitioner above named is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and condition and sureties, the learned Court may deem fit and proper.
