Section 25(8) of the Arms Act, 1959 has been added in the FIR during investigation. Both are first petitions for regular bail. 2. On 13.2.2026, when police party headed by ASI Surinder Kumar was on patrol duty, a secret information was received that Shera Singh son of Mukkha Singh and Jagroop Singh alias Yoopa were involved in illegal business of arms in Amritsar city and surrounding areas and if raid be conducted, they could be caught with illegal weapons. Raid was accordingly conducted. Shera Singh and Jagroop Singh were apprehended. From personal search of Shera Singh, Pistol .30 bore was recovered along with two live cartridges of .30 bore. Further, on search of Jagroop, one Pistol .9 mm “Made in Austrai” was recovered from his left dub alongwith two live cartridges of .9 mm. Both suffered disclosure statements regarding concealment of 3 more pistols which they had smuggled from Pakistan, pursuant to which they got recovered one pistol .32 bore along with two live cartridges and one .30 bore pistol “China Narinco” along with two live cartridges and another .30 bore pistol along with two live cartridges. 3. Prayer of learned counsel for the petitioners is for release of petitioners on regular bail on the ground that they had clean antecedents; were in custody for the last more than 6 months; that investigation was complete and trial would take long to conclude. 4. Learned State counsel opposes the prayer for regular bail on the ground of heavy quantity of illegal arms and ammunition recovered from the petitioners and the offences being grave in nature. 5. Both petitioners are in custody w.e.f.13.02.2026. Antecedents of petitioner Jagroop Singh are clean. He is not involved in any other offence. Offences are triable by Court of Magistrate. Investigation has been completed. All witnesses proposed to be examined by the prosecution are official ones, hence, there can be no occasion for the petitioners to tamper with evidence or influence them. Both petitioners have fixed abode and there is no apprehension expressed that they would evade the process of law. Truth of the allegations against both of them would be a matter of trial. 6.
