Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 1 year 7 months and till date out of 42 witnesses only 2 witnesses have been examined.
Learned advocate for the de facto complainant opposes the prayer for bail and submits that the present petitioner is one of the person who has inflicted blows with sharp cutting weapon.
Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the statement of one of the eyewitnesses under Section 164 of Cr.P.C.

I have taken into account the background of the case where the deceased in a preplanned manner went for offering prayer, the accused persons attacked him by hurling bomb and thereafter striking him with sharp weapon.
Having considered the overall materials appearing in the case diary particularly the complicity of the present petitioner which has been narrated by one of the eyewitnesses, I am of the opinion that the provisions of Article 21 of the Constitution of India at this stage considering the gravity of the offence cannot be invoked. Consequently, the prayer for bail of the petitioner in CRM(M)1702 of 2026 is dismissed at this stage.
