The Panchayat and the private respondent are not represented despite service. Learned counsel for the petitioner submits that the petitioner and the private respondent are co-sharers in respect of the plot in question. The private respondent is raising construction in the said plot without obtaining any sanctioned plan/permission from the appropriate authority. The petitioner submitted a representation before the concerned authority on 15th January, 2026 which is yet to be considered. The petitioner prays for consideration of the said representation. Upon consideration of the submission made on behalf the parties, this Court directs the Pradhan, Benota 1 Gram Panchayat, being the 4th respondent herein, to consider and dispose of the representation submitted by the petitioner dated 15th January, 2026 within two weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the 2 petitioner and the private respondent, in accordance with law. In the event any unauthorised construction raised by the private respondent is found by the authority, necessary steps shall be taken in accordance with law. The application is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
