D/L978 31.08.2026 Bpg. C.R.M. (A) 454 of 2026 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Kalna Police Station Case No.1140 of 2025 dated 21.11.2025 under Section 316(5) of the Bharatiya Nyaya Sanhita, 2023; Mrityunjoy Mondal & Anr. Versus The State of West Bengal Mr. Jaydeep Biswas Mr. Santanu Talukdar Mr. Priyankar Ganguly Ms. Shalini Bairagi Mr. Koushik Ghosh Ms. Pipasa Chakraborty. …for the petitioners. Mr. Krishnendu Bhattacharya Ms. Tanusree Kar. …for the State. Mr. Bibaswan Bhattacharya Mr. Amal Kr. Saha Mr. Iresh Paul Mr. Poonnug Roy. …for the de facto complainant. Learned advocate appearing for the petitioners submits that the petitioners have been foisted with two criminal cases by the same complainant. Investigation has progressed. Both the petitioners are innocent and learned advocate emphatically submits that the petitioners did not accept any deposits. Learned advocate for the de facto complainant opposes the prayer for anticipatory bail and submits that there are umpteen 2 investors who have been compelled. Learned advocate for the State opposes the prayer for anticipatory bail and submits that the petitioners were carrying out a chit fund business. There were no permissions from the Reserve Bank of India and there are statements to substantiate the allegations. Having considered the overall materials appearing and the present being a case for anticipatory bail, I am of the opinion that this is not a fit case to accede to such prayer. As such, the prayer for anticipatory bail of the petitioners are rejected. Accordingly, CRM(A) 454 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
