The revisional application has been preferred by the wife/petitioner praying for transfer of Matrimonial Suit No.349 of 2023 from the Court of learned Additional District Judge, FTC at Kalyani, Nadia to the Court of learned District and Sessions Judge at Barasat, North 24 Parganas. 2. It is the case of the petitioner/wife that she resides with her minor child at 2nd Floor, Vasundhara Complex, Post Office-Habra, District-North 24 Parganas, Pin-743263. 3. On the other hand, the opposite party/husband resides at B-1/251, B Block, Post Office and Police Station Kalyani, District- Nadia, Pin-741235 and has filed the matrimonial suit in the Court of learned Additional District Judge, FTC at Kalyani, Nadia. 4. Considering the said difficulty of the petitioner/wife to travel to Kalyani on regular basis, this Court relying upon the judgments of the Hon’ble Supreme Court in N.C.V. Aishwarya vs 2 A.S. Saravana Karthik Sha, in Civil Appeal No(s). 4894 of 2022 (arising out of SLP (C) No(s). 16465 of 2021), decided on July 18, 2022, (Para 11, 12), directs that Matrimonial Suit no. 349 of 2023 be withdrawn from the Court of learned Additional District Judge, FTC at Kalyani, Nadia and be transferred to the Court of learned Additional District Judge at Sealdah. 5. The learned Additional District Judge at Sealdah shall proceed with the suit in accordance with law with due notice upon both the parties. 6. Keeping in mind the case of the opposite party herein, the learned Additional District Judge at Sealdah, shall be at liberty to permit the opposite party to appear virtually, if such prayer is made. 7. CO 2448 of 2026 stands disposed of. 8. Parties to act on the server copy of this order. 9. Let a copy of this order be sent to the concerned Courts for immediate compliance. (Shampa Dutt (Paul), J.)
