The Petitioner has approached this Court for grant of regular bail in connection with Cyber P.S. Case No. 33 of 2025, registered for the offence under Sections 319(2), 318(4), 338, 336(3) & 340(2) of Bharatiya Nyaya Sanhita, 2023 and Section 66(B), 66(C) & 66(D) of the Information Technology Act. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and there is only allegation against him that two mobile phones with two SIM Cards and cash of Rs. 25,000/- have been recovered from his possession. He further submits that the petitioner is having no criminal antecedent and he is in custody since 17.09.2025; as such, the petitioner may be enlarged on bail. He further submits that the petitioner is ready to abide by every condition as imposed by this Court. 4. Learned A.P.P opposes the prayer for bail of the Petitioner. 5. Having regard to the aforesaid facts of the case and coupled with the fact that the petitioner is having no criminal antecedent and he is in custody since 17.09.2025; hence, I am inclined to enlarge the Petitioner on bail. Accordingly, the above-named Petitioner is 2026:JHHC:5638 2 directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Cyber Crime, Giridih in connection with Cyber P.S. Case No. 33 of 2025. 6. It is made clear that the Petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this Petitioner, learned trial court shall be at liberty to cancel the bail of this Petitioner.
