1. Mr. De, learned Advocate appearing for the petitioners, submits that following a free fight between two groups of people who were closely related to each other, the alleged incident occurred. He submits that petitioner no. 3 also suffered serious injuries on her person. He prays for anticipatory bail for the petitioners.
2. Mr. Datta, learned Advocate appearing for the State, produces the case diary and memo of evidence and opposes the prayer for anticipatory bail. He submits that the injury report suggests that the victim suffered serious injuries on a vital part of the body.
3. Heard the learned Advocates appearing for the respective parties and perused the materials in the Case Diary, including the injury report.
4. Noting the nature of the injuries as reflected in the injury report and considering that the incident allegedly occurred in the presence of direct evidence, I am of the view that the privilege
2 under Section 482 of the BNSS can be extended in favour of the petitioners.
5. Accordingly, I direct that, in the event of arrest, the petitioners viz. Sibani Hazra @ Shibani Hazra, Suresh Hazra and Sumana Hazra Ghorai @ Mou Ghorai Hazra shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the learned CJM Purba Medinipur at Tamluk and also subject to the conditions as laid down under Section 482(2) of the BNSS, 2023.
6. The application being CRM (A) 2281 of 2026 is disposed of.
