Respondents For Petitioner : Mr. J.K. Saxena, Advocate For State/Respondent : Mr. Anadi Sharma, PL (Hon’ble Shri Justice Bibhu Datta Guru) Order on Board 29/09/2026 ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2026.10.01 10:32:59 +0530 2 1. The instant writ petition has been filed seeking, inter alia, a direction to the respondent authorities to reconsider the petitioner's claim for regularization of his services, allegedly on the ground that he has been continuously working on daily-wage basis since 04.07.2009. 2. Learned counsel for the petitioner submits that the petitioner was appointed as a Peon on daily-wage basis on 04.07.2009 and has continued to work since then. It is submitted that the petitioner has already submitted a representation before the respondent authorities seeking regularization of his services and the same has not been decided. 3. Learned State counsel, however, points out that the petitioner had earlier approached this Court by filing W.P.(S) No. 2069 of 2026, wherein the petitioner had raised the very same grievance and sought substantially the same relief in respect of his claim for regularization. The said writ petition was decided by this Court vide order dated 26.02.2026, with liberty/direction to the petitioner to submit a comprehensive representation before the concerned authorities and for the said representation to be considered and decided in accordance with law. 4. Heard learned counsel for the petitioner and learned State counsel. 5. On perusal of the pleadings and the relief claimed in the present writ petition, it is apparent that the grievance raised by the petitioner and the relief sought herein substantially arise out of the same cause and the same claim for regularization which was already the subject matter of W.P.(S) No. 2069 of 2026. The petitioner cannot maintain a successive 3 writ petition seeking the same relief after having already approached this Court in respect of the very same grievance. 6. In view of the aforesaid, this Court is of the considered opinion that the present writ petition is not maintainable. 7. Accordingly, the instant writ petition is dismissed as not maintainable.
