The instant writ petition has been filed by the petitioners under Articles 226/227 of the Constitution of India seeking issuance of a writ of mandamus directing respondent No.1 to decide the statutory appeals dated 30.07.2026 (Annexure P-6 & P-7) along with the stay applications dated 30.07.2026 (Annexures P-8 & P-9) filed by the petitioners against the common punishment order dated 27.07.2026 (Annexure P-5), passed by respondent No.2, within a time bound manner in accordance with the applicable Service Rules read with the Government Instructions dated 03.03.1997 (Annexure P-12). Further, seeking issuance of a writ of certiorari for quashing the punishment order dated 27.07.2026 (Annexure P-5), passed by respondent No.2. 2. Learned counsel for the petitioners submit that the petitioners would be satisfied if appropriate directions are issued to respondent No.1-Appellate Authority to consider and decide the statutory appeals 30.07.2026 (Annexure P-6 & P-7) along with the stay applications dated 30.07.2026 (Annexures P-8 & P-9) filed by the VINOD KOTHIYAL 2026.08.27 15:51 I attest to the accuracy and authenticity of this document CWP-27408-2026 -2- petitioners expeditiously by passing a speaking order in a time-bound manner. He further prays that till the final disposal of the said appeals, no recovery may be effected from the petitioners. 3. Notice of motion 4. I have heard learned counsel for the parties and have gone through the case file. 6. Respondent No.1-Appellate Authority is directed to decide the statutory appeals dated 30.07.2026 (Annexure P-6 & P-7) along with the stay applications dated 30.07.2026 (Annexures P-8 & P-9) filed by the petitioners, in accordance with law by passing a speaking order as expeditiously as possible preferably within a period of 03 months from the date of receipt of certified copy of this order. 7. Since the statutory appeals filed by the petitioners are pending and yet to be decided, it will be in the interest of justice that no further recovery be effected from the petitioners. 8. The present petition stands disposed of in the above terms.
