01.09.2026 Court No.35. D/L. 53. Kausik (Rejected) CRM (NDPS) 1819 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bizpur Police Station Case No. 38 of 2026 dated 09.02.2026 under Section 20(b)(ii)(C)/29 of the NDPS Act, 1985. And In the matter of : Bablu Barman ……Petitioner. Mr. Debasis Kar Ms. Paramita Mukherjee ……for the Petitioner. Mrs. Rajashree Venket Kundalia Mr. Uttam Basak ……for the State. Learned advocate appearing for the petitioner submits that petitioner was arrested on 09.02.2026 and is in custody since the said date. The alleged recovery in the present case is 30 Kgs. 650 Gms. of Ganja from the joint possession of the petitioner and another. State has opposed the prayer for bail. It has been emphasized on behalf of the petitioner that there are no independent witnesses and there is no possibility of witness action commencing very soon. 2 Having considered the quantum of recovery in the present case, I am of the opinion that the rigors of Section 37 of the NDPS Act is attracted. As such, prayer for bail of the petitioner in CRM (NDPS) 1819 of 2026 is rejected. Learned Trial Court would expedite the process of trial and give priority to the seizure list witnesses. Petitioner would renew his prayer for bail after the aforesaid witnesses are over. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
