Learned advocate appearing for the petitioner submits that there has been alleged recovery of 5581 grams of ganja allegedly from the possession of the petitioner. The same was at the Airport. Learned advocate for the Air Customs Authority opposes the prayer for bail as there has been recovery from the Airport. It has been informed to this Court that the complaint has already been submitted before the jurisdictional court. I have taken into account the materials appearing against the present petitioner and is of the opinion that the same is covered by the judgment of Hon’ble Supreme Court in Barnali Bag Vs. Union of India (Special Leave Petition (Crl.) No.3641 of 2026). 2 Having regard to the same, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner, namely, Shaikh Adil shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, 8th Court, under NDPS Act, Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the districts of 24 Parganas (North) and 24 Parganas (South) without prior permission of the learned special court. Additionally, the petitioner shall make himself available before the investigating officer of the case or the Principal Commissioner, Airport, Air Customs Authority as and when called for. Accordingly, CRM(NDPS) 1847 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
