Heard. 2. Present is an writ petition under Article 227 of Constitution of India filed by the petitioners claiming the following reliefs. 10.1 That this Hon’ble Court may kindly be pleased to direct the Learned Additional Judge Chhuikhadan of First Civil Judge Senior Division District Khairagarh Chhuikhadan Gandai (CG) to expedite the proceedings of Civil Case No. 4A/2022 filed by the defendants and conclude the same within a period of six months in the interest of justice. 10.2 To grant any other relief which may suitable in the facts and circumstances of the case may also be allowed. 10.3 cost of the petition may kindly award to the petitioners. 3. Learned counsel for the petitioner would submit that the petitioners are defendants No. 3, 4, 5 and 6 before the learned trial Court where the Respondent No. 15 is prosecuting a suit for declaration of title, partition, order dated 06.05.2021 passed by Commissioner, Durg Division as null and void. The suit of the plaintiff is pending since 2022 and till date the issues has not been framed. He would further submit that the learned trial Court may be directed to expedite the trial and decide the same till the stipulated time frame. 4 4. I have heard learned counsel for the parties and perused the document annexed with the petition. 5. It transpires from the order passed by Coordinate bench of this Court dated 20.11.2024 passed in WP227 No. 1048/2024 (Annexure-P/3) that an order for expeditious trial of civil Suit as already been passed while deciding the petition with respect to grant of temporary injunction in favour of the petitioners. 6. Since, the order of expeditious disposal of civil suit has already been passed, yet the petitioners again prayed for expeditious disposal of the suit which in the opinion of this Court is repeated prayer made by the petitioner in the present writ petition. 7. In view of the fact that the direction for expeditious disposal has already been passed, there is no need to pass any order for expeditious disposal of civil suit, however, it is expected that the learned trial Court shall proceed in the suit expeditiously in view of the direction made by Coordinate bench of this Court on 20.11.2024 passed in WP227 No. 1048/2024 and shall conclude the same as early as possible in accordance with law on its own merits. 8.
