Learned advocate appearing for the petitioners submits that pursuant to the earlier direction passed by this Court, petitioners are renewing their prayer for bail. The evidence of five witnesses has been completed. It has also been emphasized that the seizure list witnesses who have been examined do not inspire confidence. Learned advocate for the State opposes the prayer for bail as there has been recovery of 510 grams of heroin. I have taken into account the version of the independent seizure list witnesses. Having regard to the fact that the prosecution intends to examine 6 more witnesses in support of its case and the present 2 evidence which has surfaced, I am of the opinion that some dilution has been there in respect of the rigors of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioners are allowed. Accordingly, the petitioners, namely, Asadul Mondal @ Ashadul Mondal, Munsad Sk and Tahidur Rahaman @ Tohidur Rahaman shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act, Krishnagar, Nadia. If on bail, the petitioners shall be physically present on each and every date before the learned trial court and shall not leave the district of Nadia without prior permission of the learned special court. Thus, CRM(NDPS) 1873 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
