02.09.2026 IN THE HIGH COURT AT CALCUTTA Item No.67 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Allowed C.R.M. (NDPS) 1862 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Gazole Police Station Case No. 71 of 2026 dated 25.01.2026 under Sections 21(C)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In Re : Subir Roy ... Petitioner. Mr. Arnab Chatterjee, Mr. Avik Ghosh ... For the Petitioner. Mr. Aditya Tiwari, Ms. Supriti Sarkhel ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is similarly placed as the other accused person viz. Uttam Sarkar who has been granted bail on 07.07.2026 in CRM(NDPS) 1227 of 2026. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that petitioner was present at the house when the seizure took place. It has also been submitted that there are no criminal antecedent, CDR or money trail available so far as the present petitioner is concerned. Having considered the same, I am of the opinion that the present petitioner viz., Subir Roy be released on bail by the learned Special Court/Trial Court on same terms and conditions as the other accused person viz. Uttam Sarkar who has been granted bail in CRM(NDPS) 1227 of 2026. 2 Accordingly, the prayer for bail of the petitioner is allowed. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1862 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
