Learned advocate appearing for the petitioner submits that there has been no recovery from the present petitioner although the subject matter of the case involves alleged recovery of 1.464 kgs. of brown sugar. Petitioner is in custody for a considerable period of time, as such, petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail. I have taken into account the materials appearing in the case diary and the earlier contentions advanced. State has relied upon in the charge-sheet witnesses of Yes Bank. Money transaction 2 has been heavily relied upon by the State between the principal accused and the present petitioner. There are call detail records. However, the same would be subject to issue relating to trial. Having considered the materials appearing against the petitioner and there has been no new circumstances since the bail was earlier dealt with and considered on 06.02.2026, I am of the opinion that the petitioner has failed to make out a case to overcome of Section 37 of the NDPS Act. Accordingly, CRM(NDPS)1840 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
