Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 28 days and there is a family dispute pursuant to which the present case has been engineered. Learned advocate appearing for the State has raised objection to the prayer for bail and drawn the attention of the Court to the statements under Section 183 of the BNSS. The medical reports have been produced before this Court as well as the statements of certain rehabilitation centre. There are other materials appearing in the Case Diary which points complicity of the present petitioner. I have taken into account the medico legal report which is appearing and at least at this stage there are no incriminating materials. So far as the other materials are concerned, relating to the
2 presence of toxic substances, the reports are still awaited. Having considered the overall circumstances and the period of detention, I am of the opinion that further custodial detention of the present petitioner, who is a lady, is unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Calcutta. If on bail, the petitioner shall not leave the jurisdiction of Taltala Women’s Police Station till the investigation of the case is over. Petitioner shall make herself available at the residence, the address of which must be provided to the investigating officer, as and when required for the purposes of the investigation. With the aforesaid observations, CRM (M) 2154 of 2026 is allowed.
