Order on Board (26th September, 2026) This petition be delinked from the other connected writ petitions.
2. The petitioner has filed the instant petition under Article 226 of the Constitution of India seeking direction to the respondent authorities to consider the candidature of the petitioner for appointment on the post of Training Officer (Computer Operator & Programming Assistant) and issue appointment order in her favour.
3.
Facts of the case, in brief, are that respondent No.2/Director, Employment and Training, Raipur issued an advertisement dated 5.5.2023, which was published in the daily newspaper on 6.5.2023, and subsequently amended on 13.5.2023, for filling up various posts of Training Officers in Govt. Industrial Training Institutes. The petitioner, a candidate of OBC (Non-Creamy Layer), who possessed qualification of PGDCA, submitted her application for the post of Training Officer (Computer Operator & Programming Assistant). Though she successfully participated in the written examination and secured 416th position in the combined merit list of the candidates for the said post and also appeared for the documents verifications, where her documents were duly verified but while issuing select list (Annexure
3 P/5) on 23.1.2024, the less meritorious candidate namely Versha Rani, who secured 516th position in the merit list, has been selected, ignoring the candidature of the petitioner. Thereafter, the petitioner filed a representation (Annexure P/6) before respondent No.2 but the same yielded no response. Hence this petition.
4.
Learned counsel for the petitioner submits that the petitioner obtained 416th rank in the combined merit list for the post of Training Officer (Computer Operator & Programming Assistant) and was under the zone of consideration for selection to the said post. However, despite her documents being accepted during documents verification process, the less meritorious candidate has been considered for the selection/appointment on the said post. Though the petitioner submitted a representation in this regard to respondent No.2 but no decision has been taken thereon till date. Even the respondents have not till date informed the petitioner as to why she has not been selected. He further submits that though in the Reply filed by the State, it has been stated that since the petitioner obtained admission in PGDCA course without completing her graduation (B.Sc.), which was minimum qualification to get admission in PGDCA course, she has not been considered for selection to the said post, however, it is submitted that the petitioner participated in B.Sc. (Final) examination in the year 2016, but she failed in one subject, so she appeared in the supplementary examination in the month of September, 2016 and result of the same was declared in December, 2016, in which she
4 cleared B.Sc. (Final) examination. He submits that the petitioner had taken admission for PGDCA course in the month of July, 2016, and she completed the said course in June, 2017, therefore, even if prior to clearing supplementary examination, she took admission in PGDCA course, despite that she cannot be deprived of being selected for the said post. Hence he prays that this petition may be allowed and the relief sought for by the petitioner be granted.
5. State/respondents No. 1 & 2 have filed their reply. Learned State counsel, referring to its reply, would submit that the petitioner had taken admission in PGDCA course for the Sessions July, 2016 to June, 2017 whereas she had not completed her graduation till 13.12.2016. He submits that the course of PGDCA can be pursued only after completion of graduation. The petitioner had taken admission for PGDCA course in Dr. CV Raman University, Bilaspur for sessions July, 2016 to June, 2017 whereas she did not have minimum qualification for pursuing this course i.e. graduation. As such, during documents verification, her certificate of PGDCA was not found to be worth
consideration and she was not selected for the post of Training Officer (Computer Operator & Programming Assistant), for which PGDCA certificate was one of the essential qualification. Being so, the present petition lacks any substance and is liable to be dismissed.
6. Heard learned counsel for the parties and perused the material available on record.

7. It is not in dispute that the petitioner had obtained admission in the PGDCA course in July, 2016, whereas she acquired the minimum qualification of graduation only in December, 2016. Thus, on the date of her admission to the PGDCA course, she did not possess the requisite eligibility for pursuing the said course. Consequently, the respondents cannot be faulted for not treating the said PGDCA qualification as a valid qualification for the purpose of appointment to the post in question. The fact that the petitioner subsequently completed her graduation and thereafter the PGDCA course, would not cure the initial deficiency in eligibility for admission to the PGDCA course. The mere participation of the petitioner in the selection process or verification of her documents does not confer any vested right to appointment. In the circumstances, no illegality or arbitrariness can be attributed to the respondents in not considering the petitioner for appointment. The petition, therefore, being devoid of merit, is liable to be dismissed.
8. For the aforesaid reasons, the petition fails and is, accordingly, dismissed.
9. Pending interlocutory application(s), if any, shall also stand
