(HON’BLE SHRI JUSTICE RAKESH MOHAN PANDEY)
Order on Board 30/09/2026
1. The applicant has preferred the First bail application under Section 483 of the BNSS, 2023 for grant of regular bail, as the applicant has been arrested in connection with Crime No.12/2026, registered at Police Station Sariya, District Sarangarh-Bilaigarh (C.G.) for the offence punishable under Section 20 (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as NDPS Act).
2. Case of the prosecution, in nutshell, is that on 17.01.2026 upon receiving secret information from an informer, the police P.S. Sariya intercepted the blue coloured Maruti vehicle and seized the ganja Digitally signed by ALLENA ANJANI KUMAR Date: 2026.10.01 11:14:37 +0530
2 weighing 123.30 kilograms wrapped in 120 packets with plastic tape. Based on these allegations, the aforesaid offence was registered against the present applicant.
3.
Learned counsel appearing for the applicant would argue that the applicant is an old aged lady; she has falsely been implicated; the contraband ganja was seized from the possession of co-accused person, namely, Shivam Jayaswal and on the basis of Call Details Report (CDR), she has been implicated in the case. He would submit that charge-sheet has already been filed and the applicant is in jail since 27.06.2026. He would further submit that conclusion of trial may take some considerable time. He would, therefore, pray for grant of bail to the applicant.
4. On the other hand, learned State counsel would oppose the bail application and submit that on the date of incident, the main accused Shivam Jayaswal and Dinesh Nut called the present applicant 12 times on her cell number. In memorandum statement, co-accused categorically stated that accused persons were going to sell the contraband to the present applicant. He would submit that the present applicant is involved in the commission of crime, therefore, the bail application of the present applicant deserves to be rejected.
5. I have heard the learned counsel for the parties and perused the case diary.
6. Having considered the fact that there is Call Details report, according to which, the co-accused Shivam Jayaswal and Dinesh Nut called the
3 present applicant on her cell number 12 times; in memorandum statement of Shivam Jayaswal, it emerged that he was going to hand over the contraband ganja to the present applicant; quantity of contraband ganja is above the commercial quantity and having regard to the stringent conditions under Section 37 of the NDPS Act, wherein this Court cannot satisfy itself that there are reasonable grounds for believing that the applicant is not guilty of such offence and she is not likely to commit any offence while on bail and that, bail application of co-accused Shivam Jayaswal has been rejected vide order dated 06.08.2026 passed in MCRC No.6024/2026 by this Court, I am not inclined to grant bail to the present applicant. Accordingly, the bail application is rejected. Sd/-
