Order on Board 28/09/2026
1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 716/2026 registered at Police Station Sarkanda, District Bilaspur (C.G.) for offences punishable under Sections 20(B) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act). 2. Case of the prosecution, in brief, is that the applicant along with other co-accused persons was found in illegal possession/transportation 90.700 KG contraband (ganja) without any valid authority or license, in contravention of the provisions of the NDPS Act. Accordingly, Crime
2 No. 716/2026 was registered against the applicant and other co- accused persons, and the applicant was arrested on 18.05.2026. 3. Learned counsel for the applicant submits that the applicant is a female, she is innocent, and she has falsely been implicated in the instant case. There is no conscious or exclusive possession of the contraband shown from her. She has no criminal antecedents of any nature and is languishing in jail since 18.05.2026. Investigation is complete, and the trial is likely to take considerable time to conclude. Hence, she may be released on regular bail. 4. On the other hand, learned State counsel opposes the bail application and submits that the applicant was actively involved in the commission of the alleged crime along with other co-accused persons. It is further submitted that the regular bail applications of identically situated co- accused persons, namely Ashok Bai and Laxmi Shikai, have already been considered and rejected on merits by this Court vide orders dated 23.09.2026 passed in MCRC No. 8463 of 2026 and MCRC No. 8452 of 2026, respectively. The role attributed to the present applicant is identical, and having regard to the nature and gravity of the offence under the NDPS Act, the applicant is not entitled to be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary with utmost circumspection. 6.
Considering the facts and circumstances of the case, nature and gravity of the allegations, role attributed to the applicant, and particularly taking into account that the regular bail applications of co-accused persons, namely Ashok Bai and Laxmi Shikai, have already been dismissed on merits by this Court in MCRC No. 8463 of 2026 and MCRC No. 8452 of 2026 vide orders dated 23.09.2026, and finding no substantial change in circumstances or distinguishable ground to take a
3 different view in the case of the present applicant, this Court is not inclined to grant regular bail to the applicant. 7. Accordingly, the bail application filed under Section 483 of BNSS is hereby rejected on merits. Sd/-
