1. The submissions made on behalf of the learned advocate for the petitioner as well as the learned advocate for the State and on perusal of the materials in the case diary, it appears that the petitioner is alleged to have assaulted the victim with iron rods. The investigation of the case has already ended in a charge sheet under Sections 447/427/323/307/325 of the Indian Penal Code as against the present petitioner. 2. Upon going through the materials in the case diary, it transpires that the injury report of the victim does not reflect any external injury. Charge sheet has been submitted. Charge sheet under the provisions of Arms Act was submitted against the co-accused and not against the present petitioner. 2
3. Learned advocate for the State submits that this a second anticipatory bail application filed by the petitioner. 4. Considering the aforesaid facts and circumstances and the materials in the in the case diary, prayer for anticipatory bail of the petitioner is allowed. 5. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further condition that the petitioner shall surrender before the learned jurisdictional Court within four weeks from this date and pray for bail and shall regularly attend the jurisdictional Court and shall not threaten or intimidate witnesses. 6. CRM (A) 2548 of 2026 is disposed of. 7.
