Accused Nos.1 and 3 are before this Court in this petition filed under Section 482 of BNSS 2023, seeking anticipatory bail in Crime No.89/2026 registered by Kodigenahalli Police Station, Tumakuru, for offences punishable under Sections 115(2), 118(1), 190, 137(2), 118(2), 126(2), 352 and 351(2) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the petitioners and the learned HCGP appearing on behalf of the respondent - State. - 3 - HC-KAR CNR: KAHC010509652026 NC: 2026:KHC:47177 CRL.P No. 11213 of 2026 3. Learned counsel for the petitioners submits that accused No.1 has been arrested during the pendency of this petition and he has been granted regular bail. Therefore, this petition as against accused No.1 may be dismissed as not pressed. 4. The said submission is placed on record. Accordingly, this criminal petition is dismissed as not pressed insofar as it relates to accused No.1. 5. FIR in Crime No.89/2026 was registered by Kodigenahalli Police Station in Tumakuru for the aforesaid offences against Manjunatha and others based on the first information dated 22.06.2026, received from Sujathamma, who is the wife of injured victim Nagarajappa. Apprehending arrest in the case, accused No.3 had approached jurisdictional Sessions Court in Crl.Misc.No.5224/2026, which was rejected on 06.07.2026. Therefore, he is before this Court. 6. A perusal of the material on record would go to show that accused persons and the injured victims have a serious civil dispute and they are already before the Civil Court in a case filed by Nagarajappa. It is in this backdrop, the parties had - 4 - HC-KAR CNR: KAHC010509652026 NC: 2026:KHC:47177 CRL.P No. 11213 of 2026 fought against each other on 21.06.2026 and in the said incident, accused persons allegedly had assaulted Nagarajappa and Kantharaju causing injuries to them. 7. A reading of the first information would go to show that allegation of assaulting injured victim Nagarajappa, with a weapon is found against accused No.1, whereas the allegation against accused No.3 is that he assaulted injured victim Kanthraju. Wound Certificate of Kanthraju would go to show that he has suffered only simple injuries in the incident in question. Accused No.1, who is arrested in the present case is said to have been granted regular bail. Considering the nature of allegations found against accused No.3 and the background in which the incident in question had taken place, I am of the opinion that his prayer for grant of anticipatory bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following:- 8. The petition is partly allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner No.2/accused No.3 in the event of his arrest in Crime No.89/2026 registered by Kodigenahalli Police - 5 - HC-KAR CNR: KAHC010509652026 NC: 2026:KHC:47177 CRL.P No. 11213 of 2026 Station, Tumakuru, for offences punishable under Sections 115(2), 118(1), 190, 137(2), 118(2), 126(2), 352 and 351(2) of BNS, 2023, subject to the following conditions: a. The petitioner No.2/accused No.3 shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. b. Petitioner No.2/accused No.3 shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c. Petitioner No.2/accused No.3 shall not tamper with the prosecution witnesses and he shall co- operate with the police for investigation and appear before them whenever called upon. d.
