Case No. 305 of 2026 dated 03.03.2026 under Sections 137(2)/140(2)/140(3)/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of: SARU KHAN @ ISMAUL SK ….Petitioner. Md. Learned advocate for the petitioner submits that there was an agreement between the victim and accused Md. Mainul for purchase of a land. Part consideration money was paid to the de facto complainant. Subsequently, the victim refused to sell of the said property to the accused. He also submits that the petitioner has been falsely implicated in this case due to such disputes. The de facto complainant made out false story of kidnapping for ransom upon her husband. 2. Learned advocate appearing for the State relies upon the statement of the victim recorded under Section 183 of BNSS. She submits that the victim was kidnapped for ransom of Rs. 17 lakhs. Statement recorded under Section 183 of BNSS goes to show that the victim was assaulted by the accused persons including the present petitioner. However, the case diary does not contain any 2 injury report. Moreover, investigation of the case has already completed and the charge sheet has been submitted. The principal accused Md. Mainul and other co-accused have been granted bail by the learned jurisdictional Court. 3. In such circumstances, considering the rival contentions and the materials in the case diary, prayer for anticipatory bail of the petitioner is allowed. 4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further condition that the petitioner shall surrender before the learned jurisdictional Court within four weeks from this date and pray for bail and shall regularly attend the jurisdictional Court and shall not threaten or intimidate witnesses. 5. CRM (A) 2547 of 2026 is disposed of. 6. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities. (Md. Shabbar Rashidi, J.)
