CJM AT BANGALORE. THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE V SRISHANANDA ORAL ORDER 1. Parties are present before the Court. 2. Joint memo is filed by the parties. Joint memo reads as under: " The petitioner and the respondent above named submit as follows:- 1. The respondent above named have filed a case against the petitioner for the alleged offence under section 138 of NI Act. trail court was convicted the petitioner and directed to pay the compensation amount of Rs.3,30,000/-, against the judgment the petitioner has filed appeal before the appellate court, same was confirmed therefore the petitioner filed the present petition before this Hon'ble court. - 3 - HC-KAR NC: 2026:KHC:20418 CRL.RP No. 418 of 2026 2. That at the intervention of the elders and well wishes the petitioner and respondent have settled their dispute and the petitioner agreed to pay Rs.2,80,000/- as full and final settlement petitioner is paying today Rs.2,14,000/- by way of cash and already deposited Rs.66,000/- before the trail court and petitioner as no objection to release the above said amount in favour of the respondent. Wherefore, the petitioner pray that this Hon'ble court may be pleased to record the Joint Memo and set aside the trail court judgment and acquit the petitioner, in the Interest of justice. 3. On enquiry parties agree that there is no force or undue influence or coercion in reaching out the terms of compromise. 4. Placing the joint memo on record, the following Order is passed: ORDER (i) Petition stand disposed off in terms of the joint memo. - 4 - HC-KAR NC: 2026:KHC:20418 CRL.RP No. 418 of 2026 (ii) Amount in deposit is ordered to be withdrawn by the complainant under due identification. (iii) In view of payment of entire fine amount a sum of Rs.5,000/- ordered by the Trial Magistrate confirmed by the First Appellate Court towards defraying expenses of the State is set-aside.
