ORDER 09-03-2026 Heard Mr. P. Choudhury, learned counsel for the petitioners and Mr. R. J. Baruah, learned Additional Public Prosecutor, Assam.
2. This is an application filed under Section 483 of the BNSS, 2023, praying for grant of bail to the accused/petitioners, namely, (i) Suraj Barman and (ii) Sri Abinash Thakuria in connection with Noonmati P.S. Case No. 06/2026 registered under Sections 20(b)(ii)B of the NDPS Act.
3. Today is the 60th day of detention of the petitioners.
4. The learned APP has submitted that the charge sheet has not yet submitted although it is 60th day today and the charge sheet could not be submitted because the investigation is not yet complete.
5. The petitioners are aged about 18 years and 21 years respectively and considering the length of detention, this Court is of the opinion that the petitioners require to be released on bail.
6. Accordingly, the petitioners namely, (i) Suraj Barman and (ii) Sri Abinash Thakuria shall be released on bail in connection with Noonmati P.S. Case No. 06/2026 registered under Sections 20(b)(ii)B of the NDPS Act on furnishing a bail bond of Rs.50,000/- each only, with 2(two) local sureties of the like amount to the satisfaction of the learned CJM, Kamrup (M), Guwahati. The learned Magistrate shall be at liberty to impose such other conditions as may be required to ensure participation of the petitioners in the investigation of the matter.
