JUSTICE R. NATARAJ ORAL ORDER The petitioner has sought for a writ in the nature of mandamus to direct the respondent to consider his representation dated 10.02.2026. 2. The facts in brief are that the petitioner had purchased Site No.28 in the land bearing Sy.No.11/1 of Gidadakonenahalli, Yeshwanthapura Hobli, Bengaluru North Taluk, in terms of a sale deed dated 14.09.1994. He contends that the land in the aforesaid survey number was notified for formation of 'Sir M. Vishweshwaraiah Layout'. He contends that in line with the judgment of a Co-ordinate Bench of this Court in Junjamma and others vs. The Bangalore Development Authority and others [ILR 2005 KAR 608], the petitioner got himself registered under the Bangalore Development Authority (Allotment of Site) Rules, 1984 and also filed an application seeking allotment of an alternate site. He contends that respondent did not consider his application for allotment of an alternate site and therefore, he submitted representations dated 17.06.2021 and 10.02.2026. However, - 3 - HC-KAR CNR: KAHC010134302026 NC: 2026:KHC:45182 WP No. 6028 of 2026 no action is taken by the respondent to consider the representations of the petitioner and therefore, he is before this Court seeking for a direction to the respondent to consider his representation dated 10.02.2026. 3. Learned counsel for the petitioner reiterated the above submissions. 4. Learned counsel for the respondent submits that the application of the petitioner would be considered in accordance with law and appropriate orders would be passed in the light of the judgment passed by a Co-ordinate Bench of this Court in Junjamma's case, referred supra. 5. In view of the above, this petition is allowed. The respondent is directed to consider the request of the petitioner as per the representation dated 10.02.2026 and pass appropriate orders within a period of three months from the date of receipt of a certified copy of this Order.
