Kausik (Rejected) CRM (M) 1721 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with STF (HQ) Police Station Case No. 06/2025 dated 14.07.2025 under sections 111(1)/111(3)/111(4)/111(7)/318(4)/319(2)/336(3)/338/340(1)/ 340(2)/61(2) of the BNS, 2023 read with sections 66C/66D of the IT Act and Section 38 of Aadhaar Act 2016 and section 14C/14(c) and added section 14 of Foreigner’s Act, 1946. And In the matter of : Biplab Sarkar ……Petitioner. Mr. Shashanka Shekhar Saha ……for the Petitioner. Mr. Kausik Dey Ms. Casurina Chatterjee ….for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 1 year 1 month. There is no scope of the trial commencing very soon as relating to the STF Courts there has been judicial interference. Additionally, it has been submitted petitioner is innocent and has been falsely implicated in the instant case and the earlier direction passed by this Court has not been acted upon. Learned advocate appearing for the State opposes the prayer for bail and submits that from the possession of the present petitioner two Finger Print Scanners, one Iris Scanner and one Web Camera was recovered. The background of the 2 case relate to preparation of fake documents for Bangladeshi Nationals who would be subsequently shown as Indian Nationals. Having considered the gravity of the offence and the nature of the participation of the present petitioner, I am not inclined to release the petitioner on bail. As such prayer for bail of the petitioner in CRM (M) 1721 of 2026 is dismissed at this stage. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
