VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging willful disobedience of the order dated 06.11.2024 passed by the Co-ordinate Bench of this Court in Writ Petition No.25980/2024 (GM-RES). The said petition was filed impugning an order dated - 4 - HC-KAR NC: 2026:KHC:21207-DB CCC No. 938 of 2025 05.08.2024 passed by the learned trial Court in COM.MA No.5/2024. 2. The accused had also impugned an order dated 03.05.2024 passed by the Arbitral Tribunal under Section 17 of the Arbitration and Conciliation Act, 1996. The dispute between the parties relates to a lease for the school premises. 3. The aforementioned petition was disposed of on the basis of the consent terms by the order dated 06.11.2024. It was agreed between the parties that the accused shall inform the parents of the school children about the pendency of the subject arbitral proceedings. This was to ensure that none of the parents would be taken by surprise, in the event the accused was evicted from the premises in question. The accused was also directed to report compliance. 4. Pursuant to the said order, the issue regarding informing the parents was taken up at a meeting of the accused which also included representatives of the parents. Thereafter, a circular was issued stating that an arbitral proceedings were pending regarding the subject lease. It was informed that the lease of the premises on - 5 - HC-KAR NC: 2026:KHC:21207-DB CCC No. 938 of 2025 which the school is being operated is pending adjudication before the Arbitral Tribunal. 5. The accused has also prevailed in the arbitral proceedings insofar as eviction from the premises is concerned. 6. In view of the above, we find no grounds to initiate proceedings under the Contempt of Court Act, 1971. The complaint is accordingly closed. 7. All pending applications are also disposed of.
