Vide order dated 08.07.2025, Ms. Snehlika Bhagat was appointed as Amicus Curiae to assist the Court; however, even today she has not appeared to assist the Court. From the office report, it appears that the copy of the petition was duly served upon her, therefore, it is expected from the counsel, who has been appointed as amicus to assist this Court, and/or to inform the Court about his or her inability. 2. Having regard to the above, this Court is proceeding to decide this case on the basis of the documents available on record. 3. The instant writ application has been preferred by the petitioners praying therein for the following reliefs: (i) For issuance of writ in the nature of Mandamus commanding the respondents to consider the case of petitioners for promotion as per the seniority cum gradation list prepared by the Govt. of Jharkhand Deptt. of Persousel and administrative Reference Memo no. 7 23/02 no. 1862/Ranchi dt. 31.3.03 which has been prepared keeping in the view the directions and the ratio of Apex court decision in Beerpal Singh Chauhan case. (ii) For a direction to the respondents authorities not to give effect to the seniority cum gradation list prepared by the wireless department dt. 25.1.06 and to any other list which is in complete violation of the ratio laid down in Apex court decision in Beerpal Singh Chauhan Case. 4. It appears that the main prayer of the petitioners is to consider their cases of promotion as per seniority-cum-gradation list prepared by the Government of Jharkhand dated 31.03.2003. The Writ Application was filed on 13.06.2007 and after a lapse of almost 20 years, the sole purpose of filing this writ application has 2026:JHHC:7731 3 practically become infructuous and that might be the reason that the petitioners are not taking any interest in this case. 5. Forced with this situation, the instant writ application, is hereby, dismissed for non-prosecution. Pending I.A., if any, also stands closed. (Deepak Roshan, J.)
