38 0011..0099..22002266 Ct. No. 05 adeb WPA 21662 of 2026 Pira Rani Dutta Vs. The State of West Bengal & Ors. Mr. Kalidas Saha Ms. Khushi Mollick …for the petitioner Mr. Subhankar Chakraborty Mr. Aniruddha Singha Roy Mr. Aniruddha Singh …for the State 1. Affidavit of service filed on behalf of petitioner is taken on record. 2. A case is made out that a complaint was lodged on 21st April, 2026 before the concerned police authorities but on receipt of such complaint necessary steps were not taken by the police authorities. Petitioner prays for direction upon the concerned police authorities to take steps taking note of complaint dated 21st April, 2026 and provide protection to petitioner and her family members. 3. Learned advocate representing State respondents has filed a communication dated 26th August, 2026 of Inspector-in-Charge, Mongalkote Police Station and same is taken on record. Copy of the communication is made 2 over to the learned advocate representing petitioner. 4. It is submitted on behalf of State respondents that alleging similar incident complaint was lodged previously based on which FIR was registered being Mongalkote Police Station Case No. 118 of 2026 dated 15th April, 2026 under certain provisions of BNS. On concluding investigation charge sheet dated 25th May, 2026 was filed. 5. This Court has perused complaint dated 21st April, 2026 wherefrom it appears that incident allegedly took place on 15th April, 2026 is narrated in the said complaint. There is an allegation that on 15th April, 2026 accused persons physically assaulted and threatened petitioner and her daughters and outraged modesty. Younger daughter of the petitioner suffered severe injuries and was taken to hospital. 6. Therefore, complaint dated 21st April, 2026 does not reveal subsequent incident requiring police authority to initiate criminal prosecution afresh by registering an FIR as it is found that taking note of the alleged incident on 15th April, 2026 FIR was registered on 15th April, 2026 being Mongalkote Police Station Case No. 3 118 of 2026 dated 15th April, 2026 and on concluding investigation charge sheet was filed dated 25th May, 2026. 7. Hence, no further order need be passed on this writ petition excepting direction upon the concerned police authorities to provide protection to the petitioner, if occasion so arises. 8. Writ petition stands disposed of. 9. Parties to act on server copy of this order duly downloaded from the official website of this Court. (Saugata Bhattacharyya, J.)
