Learned advocate appearing for the petitioner submits that there has been no recovery from the present petitioner and he has been implicated in the present case on the basis of statement of co-accused. State submits that although recovery in the present case is 25 bottles of Codeine Cough Syrup but materials reflect that there has been no recovery from the petitioner. Having considered that recovery was from a different person and the complicity of the present petitioner is restricted to statement of co-accused, neither there are any CDR or money trail reflecting from the report, I am of the view that further detention of the petitioner is unwarranted. As such, the prayer for bail of the 2 petitioner is allowed. Accordingly, the petitioner, namely, Osman Sk. shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, 3rd Court, under NDPS Act, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court. Thus, CRM(NDPS) 1850 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
