Kausik (Rejected) CRM (M) 1719 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bishnupur Police Station Case No. 145 of 2023 dated 19.02.2023 under sections 302/120B/34 of the Indian Penal Code, 1860. And In the matter of : Ujjawal Sarkar @ Ujjal Sarkar ……Petitioner. Mr. Moyukh Mukherjee Mr. Abhinav Rakshit ……for the Petitioner. Mr. Kallol Mondal, Sr. Adv. Mr. Gurudas Mitra Mr. Rishav Kumar Thakur ….for the State. Learned advocate appearing for the petitioner submits petitioner is in custody for almost 3 years and 6 months and only 7 witnesses have been examined while the prosecution intends to examine 16 witnesses in order to establish its case. Learned advocate submits that some of the witnesses have turned hostile. Three other accused persons have been released on bail, as such petitioner be extended the same benefit. Learned advocate appearing for the State opposes the prayer for bail and submits that it is the petitioner who was identified in the T.I. Parade. There are overwhelming materials 2 supporting the prosecution case, particularly the eye witnesses who have seen the overt acts attributed by the present petitioner who was responsible in commission of the offence. I have taken into account the materials appearing including the fact that the eye witnesses have stated petitioner was with the gun at the spot so far as preparation, participation and execution is concerned, petitioner had full knowledge of the same. Having regard to the fact the present is a case under Section 103(1) of the BNS, I am of the opinion that it would not be fit and proper after assessing the role of the petitioner to release the petitioner on bail. As such, prayer for bail of the petitioner in CRM (M) 1719 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
