1. The petitioner was appointed on the post of Shramik at Harduaganj Thermal Power Plant, Kasimpur, Aligarh vide an appointment letter dated 18.3.1988. 2. At the time of entry in service, petitioner’s date of birth was mentioned on basis of a report of medical examination dated 19.10.1987 that at that stage, petitioner appears to be 20 years old and accordingly in service records his date of birth was recorded as 19.10.1967 and same was mentioned in other documents also including information uploaded on web portal of respondent Nigam and according to said date of birth, petitioner’s date of retirement would be 31.10.2027. 3. Sri Rahul Mishra, learned counsel for the petitioner submitted that after 35 years, an inquiry was conducted behind his back regarding his
2 WRIA No. - 5542 of 2026 date of birth to determine correct date of retirement, since it was found that his date of birth was changed by making overwriting in his service book from 19.10.1967 to 14.4.1966 as well as his date of birth mentioned in Hindi as ( उ्ቐीस अक्टूबर सन् उ्ቐीस सौ सडसठ) was deleted by using white fluid and just below it was mentioned in Hindi as (चौदह अ्ቚैल सन् उ्ቐीस सौ छाछट), though the date of retirement i.e. 31.10.2027 was not disturbed. 4. The petitioner has procured some documents under The Right to Information Act, 2005, subsequently that an inquiry was initiated but its report was not submitted by the Inquiry Committee/I.G. Vigilance including Forensic Report. Therefore, the Executive Engineer communicated the Inquiry Committee vide a communication dated 22.12.2025 to inform about outcome of inquiry and same request was repeated vide another communication dated 3.2.2026.
For reference, contents of letter dated: 03.02.2026 is mentioned hereinafter:

5. In aforesaid circumstances, since neither a report was submitted by the Inquiry Committee nor I.G. Vigilance has submitted a report on basis of Forensic Report, if any information was sent by the Executive Engineer to Chief General Manager vide a communication dated 19.03. 2026 that date of birth of petitioner be considered on basis of a new document i.e. a Transfer Certificate wherein petitioner’s date of birth was mentioned as 14.04.1966 i.e. he would retire on 30.04.2026 i.e. about a year and 6 months earlier. Relevant part of aforesaid communication is reproduced hereinafter:

6. In aforesaid circumstances, for first time petitioner was informed about the decision vide a communication dated 23.03.2026 that he would retire on 30.4.2026 on basis of above referred document i.e. Transfer
6 WRIA No. - 5542 of 2026 Certificate considering his date of birth to be 14.04.1966 ignoring Date of Birth (19.10.1967) mentioned in service records. 7. In aforesaid circumstances, petitioner approached this Court by way of filing present writ petition on 12.04.2026 against orders dated 19.03.2026 and 23.03.2026. 8. Learned counsel for the petitioner referred Rule 2 of U.P. Recruitment to Services (Determination of Date of Birth) Rules, 1974 that in case at the time of entry in service, an employee has not passed High School or equivalent examination, date of birth recorded in service book at the time of entry shall be deemed to be correct date of birth or age as the case may be and since there are sufficient materials on records that date of birth of petitioner at the time of his entry into Government Service was 19.10.1967, therefore, his retirement date would be 31.10.2027, therefore, said date of birth cannot be disturbed. 9. So far as any allegation of forgery is concerned, that petitioner’s date of birth as mentioned at the time of entry into government service was 19.10.1967 which was changed as 14.04.1966, by making overwriting and using whitener, can be ignored since till date there is no proof that it was done by the petitioner. Inquiry Report of Inquiry Committee or of I.G. Vigilance or Forensic Report is still awaited. 10.
Learned counsel for the petitioner also submitted that during service, petitioner has passed High School also, however, a different date of birth was mentioned therein i.e. 16.09.1966, however, in view of above provisions same cannot be considered for purpose of retirement. 11. Learned counsel for the petitioner further submitted that date of birth as mentioned in the Transfer Certificate which has now been relied upon was issued in the year 2005 but it was not verified from original records. As per above referred provision, date of birth as mentioned in
7 WRIA No. - 5542 of 2026 service record at the time of entrance in service would be final, since on the other relevant element i.e High School Certificate which was not available at the time of entry into service. 12. Learned counsel for the petitioner has placed reliance on a judgment passed by this Court in Brij Kishore Vs. State of U.P.& Ors, 2016 (4) ESC 2148 and Union of India & Ors. Vs. Nathan Singh (2023) 2 UPLBEC 1321 that principles of natural justice were not followed before taking an adverse decision. 13. Per Contra, Sri Abhishek Srivastava and Ms.Tanisha Jahangir Monir,
learned counsel for the respondents submitted that petitioner has mentioned different date of birth in his various documents. In Aadhar Card and PAN Card, his date of birth is recorded as 16.04.1966 and 16.04.1968 respectively and in PIS Service Record it is recorded as 19.10.1967 and in the High School Certificate it is recorded as 16.09.1966 and in service records with overwriting it is 14.04.1966 and same date of birth was mentioned in the Transfer Certificate, therefore, it was a subject matter of inquiry and they referred a report dated 24.02.2024, however, it has not been denied that petitioner was not a part of said vigilance or police investigation and that report does not has any final conclusion, except that a further inquiry is required such as Forensic Reports. For reference, relevant part of report dated 24.02.2024 is reproduced hereinafter:

14. Learned counsel for the respondents have placed reliance on a
judgment passed by Supreme Court in Union of India Vs. Harnam Singh, 1993 SCC (2) 162. 15. Heard learned counsel for parties and perused the records. 16. Law in regard to determination of correct date of birth or age is well settled that provisions of Rule 2 of Rules 1974, shall be applicable that since at the time of entry into service, the petitioner has not passed High School or equivalent examination, therefore, date of birth recorded in service book at the time of entry shall be deemed to be correct date of birth. 10 WRIA No. - 5542 of 2026
17. In aforesaid background, Court finds that there are two different date of birth mentioned in the service record. One is 19.10.1967 without any overwriting and using white fluid and according to this petitioner’s date of retirement would be 31.10.2027. The other date of birth after overwriting and using white fluid is 14.04.1966 and accordingly to said date petitioner’s date of retirement would be 30.04.2026, though decision to retire him on 30.4.2026 was taken on basis of date of birth mentioned in Transfer Certificate issued in the year 2005, which is not the relevant document in terms of Rule 2 of Rules, 1974. 18. A decision to consider date of birth as 14.04.1966 being adverse to the petitioner, therefore, respondents could not take any decision at petitioner’s back and further as referred above, since outcome of inquiry still remains unconclusive, therefore, dispute among date of birth i.e. 14.04.1966 and 19.10.1967, it would be appropriate that date of birth of the petitioner be considered as 19.10.1967, since overwriting has not been proved. Otherwise also, admittedly petitioner was not called to participate in any inquiry. There are various documents in service records which consistently recorded petitioner’s date of birth as
19.10.1967. There was no reason for the petitioner to make forgery to change date of birth from 19.10.1967 to 14.04.1966, which would be against his interest, since he would retire early. 19. The Court takes note of few paragraphs of a judgment passed by Supreme Court in U.P. Madhyamik Shiksha Parishad v. Raj Kumar Agnihotri, (2005) 11 SCC 465. Relevant paragraphs of it are reproduced hereinafter:
“17. In the instant case, the U.P. Recruitment to Services (Determination of Date of Birth) Rules came into force w.e.f. 28- 5-1974.
Rule 2 of the Rules was amended by the First Amendment Rules, 1980 on 7-6-1980. The existing rule and the substituted rule are extracted hereinbelow: Column 1 (Existing rule) Column 2 (Rule as hereby

“2. The date of birth of government servant as recorded in the certificate of his having passed the High School or equivalent examination, or where a government servant has not passed any such examination as aforesaid, the date of birth or the age recorded in his service-book at the time of his entry into government service, shall be deemed to be his correct date of birth or age, as the case may be, for all purposes in relation to his service including, eligibility
for promotion, superannuation, premature retirement or retirement benefits, and no application or representation shall be entertained
for correction of such date or age in any circumstances whatsoever.”

The date of birth of a government servant as recorded in the certificate of his having passed the High School or equivalent examination at the time of his entry into the
government service or where a government servant has not passed any such examination as aforesaid or has passed
such examination
after joining the service, the date of birth or the age recorded in his service-book at the time of his entry into the
government service shall be deemed to be his correct date of birth or age, as the case may be, for all purposes in relation to his service, including eligibility for
promotion, superannuation, premature retirement or retirement benefits, and no application or representation shall be entertained
for correction of such date or age in any circumstances whatsoever.” As per the existing rule, the date of birth or the age recorded in his service-book at the time of entry into the government service shall be deemed to be the correct date of birth or age, as the case may be, for all purposes and no application or representation shall be entertained for correction of such date or age in any circumstances whatsoever. 18 [Ed.: Para 18 corrected vide Official Corrigendum No. F.3/Ed.B.J./71/2005 dated 20-8-2005.] . The amended rule of 1980 was deemed to have come into force w.e.f 28-5-1974 and as
12 WRIA No. - 5542 of 2026 per the substituted rule, the date of birth or the age recorded in the service-book at the time of entry into the government service shall be deemed to be the correct date of birth or age, as the case may be, for all purposes and that no application or representation shall be entertained for correction of date of birth or age in any circumstances whatsoever. The respondent has given his date of birth as 30-7-1941 at the time of entry into service which has also been recorded in the service records of the respondent. The above amended rule which came into force w.e.f. 7-6-1980 stipulates that no application or representation shall be entertained for correction of such date or age in any circumstances whatsoever and that the date of birth or age recorded in the service-book at the time of his entry into government service shall be deemed to be his correct date of birth or age as the case may be for all purposes. 19.
In view of the above rule, we hold that the correct date of birth of the respondent is only 30-7-1941 and the claim now made by the respondent to correct his date of birth from 30-7- 1941 to 16-10-1945 cannot at all be entertained or encouraged.”

In aforesaid circumstances, since impugned decisions suffer from errors on both account i.e. on law as well as on facts, therefore, Court finds that impugned orders dated 19.03.2026 and 23.03.2026, being passed behind the back of petitioner also as well as contrary to above referred position of law and in present set of circumstances, cannot sustain, therefore, set-aside and petitioner will continue to work considering his date of birth as 19.10.1967 i.e. his retirement date would be 31.10.2027. However, respondents will be at liberty to conclude the inquiry if still pending only with participation of the petitioner. 21. Writ Petition is accordingly disposed of. (Saurabh Shyam Shamshery,J.)
