D/L. 83. Kausik (Rejected)
CRM (A) 2837 of 2026
In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Tamluk Police Station Case No. 462 of 2026 dated 25th June, 2026 under section 69/89/351(2) of BNS.
And In the matter of : Santanu Maity
……Petitioner.
Mr. Amit Ranjan Roy
……for the Petitioner.
Mr. Pradeep Kumar Singh
Mr. Chandra Gupta Kamal
….for the State.
Learned advocate appearing for the petitioner submits that the allegations in the FIR itself do not makes out a case which a man of ordinary prudence would believe and accept the same to be correct.
State has produced the case diary.
I have taken into account the materials appearing in the case diary, particularly, the statement of the victim as well as the medical report. On an assessment of the same, I am of the view that this is not a fit case for granting anticipatory bail.
As such prayer for anticipatory bail in CRM (A) 2837 of 2026 is dismissed.
