1. Mr. Ghosh, learned Advocate appearing for the petitioners, submits that, out of personal grudge, the petitioners have been falsely implicated in this case. He submits that notice under Section 35(3) of the BNSS has been served upon the petitioners and that they have complied with the terms of the said notice. He prays for pre-arrest bail for the petitioners.
2. Mr. Chakraborty, learned Advocate for the State produces the case diary, memo of evidence and opposes the prayer for anticipatory bail.
3. Heard the learned Advocates appearing for the respective parties and perused the materials in the Case Diary. The petitioners have complied with the terms of the notice under Section 35(3) of the BNSS. Noting this fact and considering that the incident allegedly occurred in the presence of direct evidence, I am of the view that the privilege under Section 482 of the BNSS can be extended in favour of the petitioners.

4. Accordingly, I direct that, in the event of arrest, the petitioners viz. Mansurul Anwar @ Md. Mansurul Anwar, Masudul Anwar @ Sk Masudul Anowar @ Md. Masadul Anwar and Majharul Anwar @ Majarul Anowar shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the learned ACJM Arambagh and also subject to the conditions as laid down under Section 482(2) of the BNSS, 2023.
5. The application being CRM (A) 2289 of 2026 is disposed of.
