1. Affidavit-of-service filed on behalf of petitioners is taken on record.
2. A case is made out in this writ petition that respondent nos.7 to 9 are encroaching upon property of petitioner and making construction requiring intervention by concerned police authorities for protecting right of petitioners over said property.
3. It is submitted on behalf of petitioners that private respondents instituted a suit being Title Suit No.56/2018 before the civil court and obtained an ad interim order of injunction which was vacated by the appellate court on preferring Misc. Appeal by petitioners. However, aforesaid suit is pending.
4. Mr. Roy Chowdhury, learned Additional Government Pleader representing State respondents has opposed this writ petition and it is submitted that issue involved in this writ petition is civil in nature
requiring parties to approach appropriate forum.
5. On perusal of complaint dated 31st May, 2026 of petitioners, it transpires that allegation was made against private respondents that they were trying to construct on land in respect of which petitioners have right. Accordingly prayer is made thereby directing concerned police authorities to take steps for preserving right of petitioners over land in question.
6. In view of pendency of Title Suit being No.56/2018 before the civil court, this Court finds it is not apt to direct police authorities to take steps for preservation of right of petitioners in respect of land in question since such direction may have bearing on pending suit.
7. Hence, writ petition is not interfered with and same stands dismissed.
8. However, this order shall not preclude petitioners to approach appropriate forum in pursuit of remedy.
