For Complainant/Objector : Mr. Akash Shrivastava, Advocate Hon'ble Shri Justice Parth Prateem Sahu Order On Board 29/09/2026 1. This is the first bail application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of anticipatory bail to the applicant who is apprehending his arrest in connection with Crime No.392 of 2026 registered at Police Station Bhatapara (Rural), District – Balodabazar – Bhatapara (C.G.) under Sections 296, 115 (2), 316 (2) of B.N.S., 2023. BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN 2 2. Case of prosecution, in brief, is that on 13.07.2026, complainant, Mayank Banjare, lodged a written complaint at Police Station Bhatapara (Rural), alleging that he had borrowed a sum of Rs.1,00,000/- from applicant against his Mahindra XUV 500 bearing Registration No. CG-04-HQ-5777, which was kept by applicant as security. It was further alleged that, despite the complainant having repaid Rs.50,000/-, applicant demanded Rs.3,00,000/- and allegedly threatened him, obtained his signatures on certain documents at knife- point, and subsequently took away his other vehicle. Complainant further alleged that applicant abused and assaulted him and threatened to kill him unless the demanded amount was paid. On the basis of the said complaint, Crime No. 392/2026 was registered at Police Station Bhatapara (Rural) against applicant. 3. Learned counsel for applicant submits that applicant is innocent and he has been falsely implicated in this case. Applicant has not committed any offence as alleged. He submits that dispute is with regard to payment of amount towards vehicle and it is the complainant himself, who left the vehicle till the amount is paid to applicant. He submits that complainant has now entered into settlement and settlement deed has been executed on 01.09.2026. There is no other criminal antecedents against applicant of similar nature. Hence, applicant may be extended benefit of anticipatory bail. 4. Learned State counsel opposes the submission of learned counsel for applicant. He submits that serious allegations have been levelled against applicant. He further submits that there are six other criminal antecedents against applicant. 3 5. Learned counsel for complainant/objector submits that he is having no objection in grant of anticipatory bail to applicant. 6. I have heard learned counsel for parties and perused the documents placed on record. 7. Taking into consideration the facts and circumstances of the case and the nature of allegation and submission made by learned counsel for respective parties further considering the fact that parties have settled the dispute outside the Court, without commenting anything on merits of the case, I am inclined to release the applicant on anticipatory bail. 8. Accordingly, the anticipatory bail application is allowed. It is directed that in the event of arrest of the applicant in connection with the aforesaid offence, he shall be released on anticipatory bail by the officer arresting him on his executing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned arresting officer. Applicant shall also abide by the following conditions:- (i) that the applicant shall make himself available for interrogation before the investigating officer as and when required; (ii) that the applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police officer; (iii) that the applicant shall not act, in any manner, which will be prejudicial to fair and expeditious trial; and 4 (iv) that the applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
