JUSTICE M.NAGAPRASANNA ORAL ORDER Heard Sri. Vikyath B., learned counsel appearing for the petitioners, Smt. Deepthi Alva, learned High Court Government Pleader appearing for respondent No.1, Sri P. Nataraju, learned counsel appearing for respondent No.2 and have perused the material on record. 2. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have filed Joint Memo along with an affidavits. Joint Memo reads as follows: "JOINT MEMO " The petitioners and 2nd respondent humbly submits as follows: 1. The Petitioners are filing the present Petition aggrieved by the order of Cognizance in CC no 4335/2022 in Cr 26/2022 which is pending before the Hon'ble II Addi Senior Civil Judge and CJM at Tumkur for the offence punishable under section 4981, 323,504,506 r/w 34 IPC 3,4 DP Act. 2. The present Petition is filed before this Hon'ble Court based on the settlement entered between the parties in MC 27/2021 on the file of the Sr. Civil Judge JMFC T Narsipura whereby the Petitioner have agreed to pay - 4 - HC-KAR CNR: KAHC010051952023 NC: 2026:KHC:46416 WP No. 2125 of 2023 alimony of Rs 18,00,000/-(Eighteen Lakhs only) and to the same the petitioners have paid Rs 6,00,000/- (Six Lakhs only) before the Sr Civil Judge and JMFC T Narasipura and also paid Rs 20,000/- for maintenance in CrlMisc 107/2025 Before the Sr Civil Judge JMFC T Narsipura as monthly maintenance for two months, Hence the petitioner has paid Rs 6,00,000/- (Six lakhs only) to the 2nd Respondent. 3. The petitioners and submits that as per the mediation petitioners and 2ndrespondent have agreed to settle the matter pending as follows; 4. The Petitioner in has agreed to pay a balance sum of Rs. 12,00,000/-( Twelve Lakh only) as full and final settlement on account of Permanent alimony and as the 2nd respondent has agreed to withdraw all the criminal cases pending in CC no 4335/2022 in Cr no 26/2022 pending before the Hon'ble II Addl Senior Civil Judge and CJM Tumkur and Crl.Misc 107/2025 pending before the Sr. Civil Judge & JMFC T.Narasipura which is presently stayed before this Hon'ble Court in the above mentioned Writ Petitions. 5. The 2ndrespondent do not have any objections to allow the above said petition. 6. The petitioners and 2ndrespondent submit that there is no coercion or force, fraud or any undue influence in filing the above joint memo. Wherefore the petitioners and the 2ndrespondent humbly pray that this Hon'ble Court may be pleased to allow the petition in the interest of justice." 3. In the light of Joint Memo filed and offences not being against the State, I deem it appropriate to accept the - 5 - HC-KAR CNR: KAHC010051952023 NC: 2026:KHC:46416 WP No. 2125 of 2023 Joint Memo along with an affidavit and terminate the proceedings against the petitioners in the subject petition. 4. For the aforesaid reasons, the following: ORDER (i) Writ Petition stands disposed. (ii) Impugned Proceedings in C.C.No.4335/2022 in Crime No.26/2022 pending before the II Addl.Senior Civil Judge and CJM at Tumkuru and Crl.Misc.No.107/2025, on the file of the learned Sr.Civil Judge & JMFC, T.
