Kausik (Rejected) CRM (M) 1723 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Haldia Women Police Station Case No. 30 of 2016 dated 10.06.2016 under Sections 376D/376(2)(f)(i)/506 of the Indian Penal Code, 1860 read with Section 6 of the POCSO Act, 2012. And In the matter of : Sk. Hasanurjjaman @ Pappu ……Petitioner. Mr. Sabir Ahmed Mr. Dhiman Banerjee Mr. Quazi Ezaz Ahmed ……for the Petitioner. Ms. Arushi Rathore ….for the State. Learned advocate appearing for the petitioner submits that he is innocent. He was not searched by the police authorities. All on a sudden he has been arrested on or about 3rd March, 2026. Petitioner is since then in custody. There has been no progress in the case. As such, petitioner be released on bail on any stringent condition. Learned advocate for the State has pointed out that the case is of the year 2016. Petitioner was absconding for about 10 years. Very recently he has been arrested. The charges are 2 grievous, both under Section 376D and Section 6 of the POCSO Act. Having considered the conduct of the accused and without entering into the merits of the case at this stage, I am not inclined to release the petitioner on bail. Accordingly, CRM (M) 1723 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
